Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Amaka Jobs ("Amaka Jobs," "we," "us," or "our"), governing your access to and use of the Amaka Jobs mobile application, website, and all related services (collectively, the "Platform"). By downloading, registering on, accessing, or using the Platform in any way, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Platform. These Terms are governed by the laws of the Federal Republic of Nigeria.
Eligibility
To use the Platform, you must:
- Be at least eighteen (18) years of age
- Have the legal capacity to enter into binding contracts under Nigerian law
- Not be barred from receiving services under the laws of Nigeria or any other applicable jurisdiction
- If registering on behalf of a company or organisation, have the authority to bind that entity to these Terms
Note
- We reserve the right to verify your eligibility at any time and to suspend or terminate your account if you do not meet these requirements.
Definitions
The following definitions apply throughout these Terms:
- "Job Seeker" means any individual who uses the Platform to search for, view, save, or apply to employment opportunities.
- "Employer" means any individual, company, organisation, recruiter, or agency that uses the Platform to post jobs, source candidates, or hire personnel.
- "Content" means any text, images, documents, CVs, job postings, messages, reviews, or other materials submitted, uploaded, or transmitted through the Platform.
- "User Account" means the registered account created by a User to access the Platform.
Account Registration and Security
To access most features of the Platform, you must create a User Account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate
- Keep your password and login credentials confidential at all times
- Notify us immediately of any unauthorised access to or use of your account
- Be solely responsible for all activities that occur under your account
Note
- We may suspend or terminate your account at our sole discretion if we suspect any breach of these Terms, fraudulent activity, or misuse of the Platform.
Use of the Platform
Your use of the Platform depends on your role:
Job Seekers
- As a Job Seeker, you may use the Platform to create a profile, upload your CV, search and apply for jobs, communicate with employers, and access career resources. You are responsible for the accuracy of all information you provide and for evaluating any job opportunity independently before accepting it.
Employers
- As an Employer, you may post job vacancies, search candidate profiles, communicate with applicants, and manage recruitment activities.
- Post only genuine, lawful job opportunities
- Comply with all applicable Nigerian labour, anti-discrimination, and data protection laws
- Not request payment, fees, or personal financial information from Job Seekers as a condition of employment
- Not use the Platform for multi-level marketing, pyramid schemes, illegal recruitment, or human trafficking
- Handle all candidate personal data lawfully and in accordance with the Nigeria Data Protection Act, 2023
Prohibited Conduct
You agree NOT to use the Platform to:
- Post false, misleading, fraudulent, or deceptive content
- Impersonate any person, company, or entity, or misrepresent your affiliation with anyone
- Harass, threaten, abuse, defame, stalk, or discriminate against any other User
- Solicit sexual favours, engage in sexual harassment, or post sexually explicit content
- Post job listings that discriminate on grounds prohibited by Nigerian law (such as ethnicity, religion, gender, or disability), except where a genuine occupational requirement applies
- Upload viruses, malware, spyware, or any harmful code
- Scrape, harvest, or extract data from the Platform using bots, crawlers, or automated tools without our written consent
- Reverse-engineer, decompile, or attempt to derive the source code of the Platform
- Use the Platform to commit fraud, advance-fee scams, money laundering, or any criminal activity
- Circumvent the Platform to deal with another User outside Amaka Jobs in a manner intended to avoid fees
- Violate any applicable Nigerian or international law
Note
- Violation may result in immediate account suspension or termination and may be reported to law enforcement authorities.
User Content and Licence
You retain ownership of the Content you submit to the Platform. By submitting Content, you grant Amaka Jobs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, modify, display, distribute, and otherwise use the Content for the purpose of operating, providing, improving, and promoting the Platform. You represent and warrant that:
- You own or have all necessary rights to the Content you submit
- Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party
- Your Content is accurate, lawful, and not misleading
Note
- We reserve the right (but have no obligation) to review, moderate, edit, or remove any Content at our sole discretion.
Payments, Subscriptions, and Refunds
Certain features of the Platform may require payment of fees or subscription charges. By purchasing a paid feature, you agree to:
- Pay all applicable fees, taxes, and charges in the currency stated
- Provide accurate, current billing information
- Authorise us and our payment processors to charge your selected payment method
Note
- All payments are processed by licensed Nigerian payment service providers. Subscription fees are non-refundable except where required by law or expressly stated in our refund policy. We may change our pricing at any time, with notice to existing subscribers.
- In the event of failed payment, chargeback, or dispute, we may suspend or restrict access to paid features until the matter is resolved.
In-App Messaging
The Platform provides in-app messaging to enable communication between Job Seekers and Employers. You agree to use this feature only for legitimate recruitment-related purposes. We may monitor, review, or moderate messages to detect fraud, harassment, spam, or violations of these Terms, in accordance with our Privacy Policy and applicable law. Amaka Jobs is not a party to communications between Users and is not responsible for the content, accuracy, or consequences of any message exchanged on the Platform.
Location Data and Push Notifications
With your permission, the Platform may collect location data to recommend nearby jobs and improve relevance. You may enable or disable location services through your device settings at any time. We may send you push notifications regarding job alerts, application updates, messages, and Platform announcements. You may disable notifications at any time through your device or in-app settings.
Third-Party Login and Services
You may register or sign in using Google, LinkedIn, or other third-party authentication providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
Intellectual Property
The Platform, including its design, software, source code, logos, trademarks, text, graphics, and all related materials, is the exclusive property of Amaka Jobs or its licensors and is protected by Nigerian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal or internal business use, strictly in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Platform without our prior written consent.
Disclaimers and No Warranty
Amaka Jobs is a neutral technology platform that connects Job Seekers and Employers. WE ARE NOT AN EMPLOYER, RECRUITER, OR EMPLOYMENT AGENT, AND WE ARE NOT A PARTY TO ANY EMPLOYMENT, CONTRACT, OR BUSINESS RELATIONSHIP THAT MAY ARISE BETWEEN USERS. To the maximum extent permitted by Nigerian law, the Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. We expressly disclaim all warranties, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses
- Warranties regarding the accuracy, reliability, completeness, or quality of any Content, job listing, application, profile, or User
- Warranties that any job posting will lead to employment, or that any candidate will be qualified, suitable, available, or honest
- Warranties regarding the conduct, character, identity, background, or actions of any User
Note
- WE DO NOT VERIFY, ENDORSE, OR GUARANTEE THE IDENTITY, QUALIFICATIONS, BACKGROUND, INTENTIONS, OR REPRESENTATIONS OF ANY EMPLOYER OR JOB SEEKER. You are solely responsible for conducting your own due diligence, background checks, interviews, and verification before entering into any employment relationship, contract, or transaction with another User.
Limitation of Liability
To the fullest extent permitted by Nigerian law, AMAKA JOBS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, consequential, special, exemplary, or punitive damages
- Loss of profits, revenue, business, opportunity, goodwill, data, or reputation
- Any acts, omissions, conduct, misrepresentation, fraud, negligence, or misconduct of any User, Employer, Job Seeker, or third party
- Any harm, injury, abuse, harassment, discrimination, assault, or damage arising from interactions, communications, meetings, interviews, employment, or any relationship between Users
- Any loss arising from the accuracy or content of job postings, profiles, CVs, references, or any other User-submitted Content
- Any unauthorised access to or use of your account, data, or device
- Any interruption, suspension, downtime, technical failure, or termination of the Platform
- Any failure of a third-party service, including payment processors, authentication providers, or hosting services
Liability Cap
- To the extent that liability cannot be excluded under Nigerian law, our total aggregate liability to you for any and all claims shall not exceed the greater of: (a) the total amount you have paid to Amaka Jobs in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) Ten Thousand Naira (₦10,000).
- Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence, fraud, wilful misconduct, or any other liability that cannot be lawfully excluded under Nigerian law.
Indemnification
You agree to defend, indemnify, and hold harmless Amaka Jobs, its parent, subsidiaries, affiliates, directors, officers, employees, agents, contractors, licensors, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:
- Your use or misuse of the Platform
- Your breach of these Terms, the Privacy Policy, or any applicable law
- Any Content you post, submit, transmit, or share through the Platform
- Any job posting, recruitment process, hiring decision, employment relationship, or transaction entered into with another User
- Any dispute, disagreement, or cause of action between you and any Employer, Job Seeker, or third party
- Any harm, injury, abuse, harassment, discrimination, fraud, scam, exploitation, assault, defamation, theft, or loss caused by or suffered by you or any other User
- Any violation of the rights of a third party, including intellectual property, privacy, or contractual rights
- Your negligence, wilful misconduct, or unlawful conduct
Note
- This indemnity shall survive the termination of these Terms and your use of the Platform. We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you.
Assumption of Risk
You acknowledge and agree that:
- Interactions with other Users, both online and offline, carry inherent risks
- Amaka Jobs does not perform criminal background checks, credit checks, identity verification, or employment-history verification on Users (except where expressly stated)
- You assume all risks associated with communicating, meeting, interviewing, contracting with, working for, or employing any other User
- You are solely responsible for taking reasonable precautions, including verifying identities, conducting interviews in safe environments, reviewing contracts, and consulting independent professional advisers before making any employment or business decision
Suspension and Termination
We may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:
- Breach of these Terms or any applicable law
- Fraudulent, abusive, or harmful conduct
- Repeated complaints from other Users
- Inactivity for an extended period
- Technical, security, or legal reasons
Note
- You may terminate your account at any time by following the in-app instructions or contacting support. Termination does not relieve you of any obligations accrued prior to termination, including payment obligations and indemnification. Sections that by their nature should survive termination shall survive.
Modifications to the Platform and Terms
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We may also update these Terms from time to time. Material changes will be communicated through the Platform, by email, or by other reasonable means. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications failures, cyberattacks, or power outages.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be attempted to be resolved amicably through good-faith negotiation. If the parties fail to reach a resolution within thirty (30) days, the dispute shall be referred to arbitration in accordance with the Arbitration and Mediation Act, 2023 of Nigeria. The arbitration shall be conducted in Lagos, in the English language, before a sole arbitrator appointed by mutual agreement, or failing such agreement, by the Chartered Institute of Arbitrators (Nigeria Branch). The decision of the arbitrator shall be final and binding. Notwithstanding the above, we reserve the right to seek injunctive or equitable relief in any court of competent jurisdiction in Nigeria to protect our intellectual property or confidential information.
Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms freely, including in connection with a merger, acquisition, restructuring, or sale of assets.
Entire Agreement
These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Amaka Jobs regarding the Platform and supersede all prior agreements, communications, and understandings, whether written or oral.
